A Prenuptial Agreement (“PreNup”) is one of the many types of domestic contracts that a couple can enter into.  A PreNup is intended to fix and determine the status, ownership and division of all property now owned or acquired by the spouses prior to and during the marriage.

A PreNup may be similar to a Cohabitation Agreement. The main difference is that a PreNup is prepared in contemplation of marriage and a Cohabitation Agreement does not necessarily have to contemplate marriage.

Couples may have a difficult time bringing up a PreNup with their intended spouse. Your Calgary divorce lawyer or family lawyer can help you with this and explain that while you can hope for the best, you have to plan for every situation. PreNups also encourage spouses to have important discussions about their finances early on – something most couples ignore.

Ultimately, the decision of whether to get a PreNup is a personal one and will depend on the circumstances. However, having a discussion with a family lawyer or divorce lawyer can help you in making that decision.

PreNups Are Advantageous For The Following Reasons

  1. Certainty and Predictability – Spouses want the certainty and predictability of knowing how their assets will be dealt with in the event of separation, divorce or death. Having an enforceable PreNup allows for this.
  2. Fair Asset Distribution – Spouses enter into marriages with various net worth and various types of assets. Individuals are delaying early marriages, pursuing their careers and acquiring their own individual net worth base before entering into a marriage. Where one spouse has worked tirelessly to build their own individual net worth, without contribution from their intended spouse, it may be fair to keep a part or the whole of that asset acquired prior to marriage, and any increase in value subsequent to marriage, exempt from future distribution.
  3. Cost-Benefit Analysis – Separation and Divorce can be costly. If the parties cannot amicably come to an agreement on the division of their matrimonial assets after separation, litigation can be costly – both financially and emotionally.  Having an enforceable PreNup allow separated spouses to move forward in a more cost-effective way.
  4. Maintaining Exemption on Exempt Property – Certain types of property may already be exempt by legislation. For example, property acquired prior to the marriage (or relationship) and inheritance are already exempt. However, when spouses co-mingle that with other matrimonial property, or when spouses put those exempt property into joint names, they risk losing part or the whole of the exemption. As well, an increase in the value of exempt property during the marriage count as matrimonial property.   Having an enforceable PreNup allows separated spouses to maintain their exemptions even if there is an increase in value or even if they are co-mingled.
  5. Other Considerations – One of the most common uses of PreNups is to keep businesses or corporations separate and apart from matrimonial property division. Like all other assets acquired during the course of a marriage, the value of a business or corporation, including the assets and share therein, may be considered matrimonial property. Businesses or Corporations may also be bound with their own internal agreements and often require or request that a spouse enter into a PreNup to separate and keep exempt their share of the business or corporation.

If you and your spouse are contemplating filing for a divorce, the chances are that things are pretty rocky. You may have tried everything in your power to make it work but to no avail. While we don’t necessarily recommend that you stay in a relationship that is unhealthy, divorce is a serious concept, and there are some things you may need to consider before making any rash decisions.

What You Need to Consider Before Hiring a Divorce Lawyer

  1. Is the Relationship Truly Over?

The first thing you need to do is ask yourself if the relationship is truly over. Do you want to make it work? Are you making an emotional decision? You and your spouse may want to consider these questions before proceeding with a Calgary divorce lawyer.

  1. Consider the Negative Consequences of Divorce

Again, while you shouldn’t stay in a relationship that is toxic, unhealthy, or abusive, you should be aware of all the negative consequences of divorce. A separation may require you to move which could affect your career, social life, and financial state, not to mention putting your children at risk for additional distress.

  1. Who Will Have Custody?

If you have kids, divorce can be a little trickier. You may want to work out some of the details of your custody agreements before meeting with a Calgary divorce lawyer. Luckily, divorce and family law firms are experienced and knowledgable about the subject and will be able to provide some guidance on the matter of child custody.

  1. What Will Your Relationship Be Like?

Divorce tends to cause hurt feelings and emotional distress. If your separation is amicable, you might be able to count on a healthy relationship after the divorce. Before signing any papers, it’s a good idea to consider how you will act around your spouse after the divorce, how often you will see each other and what your overall relationship will be.

If you’re seeking a divorce, the chances are that you want to settle the matter as quickly and fairly as possible. Going to court makes the process take longer and can be emotionally exhausting. Family lawyers can help you avoid going to court during a divorce, and can guide you through the process when a trial is necessary.

Resolving all the issues related to a divorce through mediation, settlement, or negotiation is ideal. Calgary divorce lawyers are competent negotiators with experience navigating the system. They understand the strategies for securing a settlement and can work toward a favourable result.

A Family Law Firm Understands Alternative Options

Going to court isn’t the only way to conclude a divorce. You probably aren’t aware of all the options available to you, but family lawyers handle many divorces and understand the different options. The following are a few options that may be open to you:

  • Mediation – An impartial mediator helps solve divorce disputes.
  • Collaborative divorce – Divorcing couples use open communication and work together to solve issues.
  • Alternate resolution – Couples negotiate the essential terms of the divorce agreement.

Family Lawyers with a Strong Reputation

Surprisingly, one right way to avoid going to court is by working with a family law firm that has a strong reputation for having effective, competent trial lawyers. Having a reputation as a successful litigator in divorce cases helps Calgary divorce lawyers secure a favourable settlement at any point in a divorce case. Going through a divorce is a complicated process. One of the first things you should ask if you find yourself facing a divorce is “Do I need a lawyer?” Some couples can work things out with the help of a neutral third party, but for many, this isn’t an option. Consider this information as you decide whether you need a divorce lawyer.

A Divorce Lawyer can Fan the Flames

Choosing the wrong lawyer may be worse than not having one at all. Some lawyers are overly aggressive and can turn the divorce into a battle that goes on longer than necessary. Avoid creating additional tension by looking for a Calgary divorce lawyer who matches your level of intensity. If you want an amicable divorce, look for a lawyer that will work toward that; if you need a more aggressive lawyer, look for someone willing to go head to head with your spouse’s lawyer.

When to Hire a Calgary Lawyer

There are a number of situations when it makes a lot of sense to work with a divorce lawyer. If there is a problem with abuse, your spouse is being vindictive or dishonest, you have complicated finances, or your spouse has a lawyer, then you should contact a law firm and seek assistance. In these and other stressful situations, it’s challenging for people to represent themselves and negotiate effectively.

A Law Firm Helps You Through the Complicated Process

Divorce is a complicated legal process. Working with a law firm is a great way to make sure that everything is taken care of properly. Divorce lawyers are a great resource and can answer your questions and help the process proceed more smoothly.

Divorce is messy and complicated. Although you may be able to wade through the proceedings on your own, it’s usually wise to hire a Calgary lawyer.

Getting top-rate legal advice involves more than finding the closest person with a law school diploma. Training, experience, and track records are important considerations, but you should also pay attention to the characteristics of a lawyer. Watch for these three characteristics of a great divorce lawyer when you’re interviewing potential lawyers.

1. Honesty in Calgary Divorce Lawyers

Honesty is important for any divorce case; you need to be honest with your lawyer and they need to be honest with you. Avoid divorce lawyers who make promises that sound too good to be true that they can’t back up. Look for divorce lawyers in Calgary who are realistic about your case and upfront about your options. Choose someone with whom you feel comfortable and can communicate well.

2. Professional Divorce Lawyers Calgary

Calgary divorce lawyers should be professional. This includes being respectful and polite, arriving on time, looking the part, and having integrity. They should also speak eloquently and maintain composure no matter how they feel. Don’t work with a lawyer who looks like they just rolled out of bed or loses their cool when frustrated.

3. An Available Divorce Lawyer

The best lawyers in the world are no good to you if you can’t ever reach them. Look for divorce lawyers in Calgary who respond to your questions and phone calls promptly. Most divorce lawyers work on multiple cases at once, but they should still be available when you need them. Ask the divorce lawyer about their average response time and what the best way to reach them is when you need help. Find out if they have additional support staff who can assist you when they aren’t available.

Don’t face the divorce process alone. Looking for these three characteristics when interviewing potential Calgary divorce lawyers can help you find the right one to represent you.

Perhaps you have thought about representing yourself in a divorce case. In almost every situation, we recommend against this because you don’t have the knowledge to defend yourself in court from someone else who has hired a lawyer. The average lawyer in Canada has a four-year bachelor’s degree with a three-year degree in law. They understand the intricate laws that the common person doesn’t know about. If you want a more favorable divorce, hire a Calgary family lawyer. Even after becoming a lawyer, practitioners of law must stay in a continual process of learning because these laws change often.

Held to High Standards

Your family law firm will almost always be held to an incredibly high standard of conduct in the legal realm. They must meet with professional ethics, and they will be bound by the Code of Conduct. As a result, they owe their clients the most competent legal services they can give.

More Effective Legal Representation

Lawyers have a better understanding of what will be important to a judge to make the most impact in your divorce case. For example, perhaps your wife of 30 years moved out early, taking all your stuff with her. In truth, this was an unlawful move, and the lawyer will bring it up in court to get you a more favorable ruling. Going through family lawyers is almost always a better choice than trying to represent yourself.

Polished and Concise Presentation of Your Case

Family lawyers have handled hundreds of cases before. As a result, they will have a deeper understanding of how to present your case in court so that you have the most impact.

No Emotional Decisions

There is a reason even divorce lawyers choose to hire another lawyer. A family law firm keeps their emotions out of the case. Representing yourself can mean making foolish mistakes because you’re too close to the situation to make good judgments.

Through a Calgary family lawyer, you increase your chances of getting a more favorable ruling in the divorce courts. Lawyers have a valuable specialty to get the upper hand. However, choosing to represent yourself can turn into a disaster because of how you don’t have the same experience with knowing the various divorce laws and how to win in court.
