A Prenuptial Agreement (“PreNup”) is one of the many types of domestic contracts that a couple can enter into.  A PreNup is intended to fix and determine the status, ownership and division of all property now owned or acquired by the spouses prior to and during the marriage.

A PreNup may be similar to a Cohabitation Agreement. The main difference is that a PreNup is prepared in contemplation of marriage and a Cohabitation Agreement does not necessarily have to contemplate marriage.

Couples may have a difficult time bringing up a PreNup with their intended spouse. Your Calgary divorce lawyer or family lawyer can help you with this and explain that while you can hope for the best, you have to plan for every situation. PreNups also encourage spouses to have important discussions about their finances early on – something most couples ignore.

Ultimately, the decision of whether to get a PreNup is a personal one and will depend on the circumstances. However, having a discussion with a family lawyer or divorce lawyer can help you in making that decision.

PreNups Are Advantageous For The Following Reasons

  1. Certainty and Predictability – Spouses want the certainty and predictability of knowing how their assets will be dealt with in the event of separation, divorce or death. Having an enforceable PreNup allows for this.
  2. Fair Asset Distribution – Spouses enter into marriages with various net worth and various types of assets. Individuals are delaying early marriages, pursuing their careers and acquiring their own individual net worth base before entering into a marriage. Where one spouse has worked tirelessly to build their own individual net worth, without contribution from their intended spouse, it may be fair to keep a part or the whole of that asset acquired prior to marriage, and any increase in value subsequent to marriage, exempt from future distribution.
  3. Cost-Benefit Analysis – Separation and Divorce can be costly. If the parties cannot amicably come to an agreement on the division of their matrimonial assets after separation, litigation can be costly – both financially and emotionally.  Having an enforceable PreNup allow separated spouses to move forward in a more cost-effective way.
  4. Maintaining Exemption on Exempt Property – Certain types of property may already be exempt by legislation. For example, property acquired prior to the marriage (or relationship) and inheritance are already exempt. However, when spouses co-mingle that with other matrimonial property, or when spouses put those exempt property into joint names, they risk losing part or the whole of the exemption. As well, an increase in the value of exempt property during the marriage count as matrimonial property.   Having an enforceable PreNup allows separated spouses to maintain their exemptions even if there is an increase in value or even if they are co-mingled.
  5. Other Considerations – One of the most common uses of PreNups is to keep businesses or corporations separate and apart from matrimonial property division. Like all other assets acquired during the course of a marriage, the value of a business or corporation, including the assets and share therein, may be considered matrimonial property. Businesses or Corporations may also be bound with their own internal agreements and often require or request that a spouse enter into a PreNup to separate and keep exempt their share of the business or corporation.

It’s no secret that divorce is difficult, particularly on children. They may not understand what’s happening and can feel confused, frightened, and rejected. Lending comfort and helping them work through the situation is important. Here’s how you can support your kids during a divorce.

Advice On Supporting Your Kids From Your Divorce Lawyers

  • Make It Clear Your Children are Loved
Kids often assume they are to blame when parents turn to divorce. Reassure your children often that they are loved and the divorce isn’t their fault. Explain that what happened is between daddy and mommy and not a result of anything they did.
  • Help Kids Express Their Feelings
Children need to be able to ask questions and share their feelings about what’s happening with their parents. They may not want to talk right away, but let them know they can come to you whenever they want. Encourage them to be honest, and help them use words to express their emotions by asking them how they are feeling and being a good listener. Reassure them that their feelings and concerns are valid.
  • Offer Support to Children During The Divorce
Suggest ways to help kids feel better as you navigate your divorce, like going on a walk, sitting together, holding a favourite toy, or talking to a parent on the phone. Ask them what might help them feel better, and let them share ideas too.
  • Save the Fighting For The Divorce Lawyer
No matter how upset you are with your ex, try to avoid yelling, arguing, or violent behaviour in front of your kids. As much as you hate your partner at this moment, they could be a great parent, so don’t ruin their relationship with your children. Focus the fight in the courts with your Calgary divorce lawyers.

Navigating divorce law is a difficult task for you, which is why you leave it to the family lawyers. When it comes to your kids, give yourself and your children the time and space you need to work through the change.

If you and your spouse are contemplating filing for a divorce, the chances are that things are pretty rocky. You may have tried everything in your power to make it work but to no avail. While we don’t necessarily recommend that you stay in a relationship that is unhealthy, divorce is a serious concept, and there are some things you may need to consider before making any rash decisions.

What You Need to Consider Before Hiring a Divorce Lawyer

  1. Is the Relationship Truly Over?

The first thing you need to do is ask yourself if the relationship is truly over. Do you want to make it work? Are you making an emotional decision? You and your spouse may want to consider these questions before proceeding with a Calgary divorce lawyer.

  1. Consider the Negative Consequences of Divorce

Again, while you shouldn’t stay in a relationship that is toxic, unhealthy, or abusive, you should be aware of all the negative consequences of divorce. A separation may require you to move which could affect your career, social life, and financial state, not to mention putting your children at risk for additional distress.

  1. Who Will Have Custody?

If you have kids, divorce can be a little trickier. You may want to work out some of the details of your custody agreements before meeting with a Calgary divorce lawyer. Luckily, divorce and family law firms are experienced and knowledgable about the subject and will be able to provide some guidance on the matter of child custody.

  1. What Will Your Relationship Be Like?

Divorce tends to cause hurt feelings and emotional distress. If your separation is amicable, you might be able to count on a healthy relationship after the divorce. Before signing any papers, it’s a good idea to consider how you will act around your spouse after the divorce, how often you will see each other and what your overall relationship will be.

If you’re facing a difficult family situation, such as divorce or child custody, you may be wondering if you need a family lawyer. Although you aren’t required to hire one, here are some good reasons to have a Calgary family lawyer on your side.

Advocacy and Legal Protection with a Family Law Firm

Legal cases are complicated. If you aren’t familiar with the ins and outs of family law, it’s easy for other parties to intimidate or take advantage of you. Family lawyers understand family law so they can help protect your rights and make your case persuasive.

Family Lawyers Calgary Follow Proper Legal Procedures

There are many legal documents and procedures involved in family law cases. A family law firm makes sure that all the necessary documents are completed and filed at the appropriate times. Failure to draft, serve, or file a document properly can lead to it being excluded as evidence.

Qualified and Objective Support from a Calgary Family Lawyer

A Calgary family lawyer should be the person you turn to for legal advice during a divorce. They represent your best interests but have the experience and knowledge to evaluate the situation. Since they aren’t personally involved, they are often better at seeing the whole picture.

Financial Security with Family Lawyers

You’ll need to pay the family law firm a fee for representing you, but hiring family lawyers Calgary may actually help you save money in the long run. Without one, you could end up paying more for child support or spousal maintenance, or not receiving enough. You could have to go back to court, or your assets may not be divided fairly.

Family lawyers help you navigate difficult family disputes efficiently. Increase your peace of mind as you approach a legal battle by hiring a family lawyer to represent you.

Every marriage experiences bumps. Even in healthy marriages, the thought of divorce has likely come up. Before you start packing your bags, take a moment to consider these relationship tips from those who have seen the worst: divorce lawyers. Here’s what they want you to know.

A Calgary Lawyer Understands that Marriage is in Progress

No marriage is perfect or static. A relationship is a work in progress that changes all the time. Don’t expect to work hard and achieve a perfect marriage; instead, focus on working on being married every day. A Calgary family lawyer recommends thinking of a reason why you love your partner to battle feelings of frustration or boredom in your marriage.

Consider Therapy before Talking to a Calgary Divorce Lawyer

A lot happens in a marriage, particularly in the first few years. Maintaining a strong relationship through life-altering events can be challenging. Getting counselling is a great option for many couples, even if things seem like they are going great. It’s especially important to talk to a therapist before talking to a Calgary family lawyer.

A Calgary Family Lawyer Recommends Boundaries with In-Laws

Getting married suddenly throws you into a whole new set of family dynamics. As much as you may love the in-laws, there’s bound to be friction at times. Divorce lawyers recognize the importance of setting boundaries as a couple. Remember that you are creating a family together.

Avoid Saying “Never” and “Always”

A Calgary divorce lawyer hears the words always and never a lot. They often hear their clients say things such as, “You never listen to me” or “You’re always so critical.” These words aren’t a good way to help your spouse understand how you feel, and they tend to encourage blowout arguments.

Learn from the experience of a Calgary lawyer, and use these relationship tips to help make your marriage stronger.

People often wonder if they can represent themselves instead of hiring family lawyers. If you’re facing a family law case and want to know whether or not you should represent yourself, consider the following information.

Can I Represent Myself without Calgary Family Lawyers?

The short answer is yes – you have the legal right to represent yourself without the assistance of a law firm in Calgary. Perhaps a better question to ask is “Should I represent myself?” The answer to this question depends on a number of factors such as how complicated your case is and whether you can afford to hire a lawyer.

Complicated Family Law Cases

Family law is often complicated. Some of the factors that make cases more involved include:

  • Minor children
  • A significant disparity between the partners’ incomes
  • Owning real estate
  • Interest in retirement benefits
  • Interest in a business
  • Marriage of 10 years or more

If any of the above apply to your situation, then you have too much at stake and should hire Calgary family lawyers to represent you.

The Cost of a Calgary Law Firm

Many people wish to avoid hiring a lawyer because they think that they can’t afford to. It’s often the case, however, that you can’t afford not to hire Calgary family lawyers. The legal process is difficult to navigate; if you aren’t familiar with it, you could make mistakes that cost you time and money. Getting expert assistance from a law firm in Calgary from the beginning can help you avoid costly errors and obtain the best results possible the first time.

Representing yourself is possible, but in most family cases it’s better to hire a reputable law firm in Calgary to give you expert guidance throughout the legal process.

If you’re seeking a divorce, the chances are that you want to settle the matter as quickly and fairly as possible. Going to court makes the process take longer and can be emotionally exhausting. Family lawyers can help you avoid going to court during a divorce, and can guide you through the process when a trial is necessary.

Calgary Divorce Lawyers Work Toward a Favourable Settlement

Resolving all the issues related to a divorce through mediation, settlement, or negotiation is ideal. Calgary divorce lawyers are competent negotiators with experience navigating the system. They understand the strategies for securing a settlement and can work toward a favourable result.

A Family Law Firm Understands Alternative Options

Going to court isn’t the only way to conclude a divorce. You probably aren’t aware of all the options available to you, but family lawyers handle many divorces and understand the different options. The following are a few options that may be open to you:

  • Mediation – An impartial mediator helps solve divorce disputes.
  • Collaborative divorce – Divorcing couples use open communication and work together to solve issues.
  • Alternate resolution – Couples negotiate the essential terms of the divorce agreement.

Family Lawyers with a Strong Reputation

Surprisingly, one right way to avoid going to court is by working with a family law firm that has a strong reputation for having effective, competent trial lawyers. Having a reputation as a successful litigator in divorce cases helps Calgary divorce lawyers secure a favourable settlement at any point in a divorce case. Plus, they’ll be ready if it does go to trial.

A divorce shouldn’t leave you feeling like you’re on shaky ground. Take control of your case and avoid going to court unless it’s really necessary with the help of a family divorce law firm.

Going through a divorce is a complicated process. One of the first things you should ask if you find yourself facing a divorce is “Do I need a lawyer?” Some couples can work things out with the help of a neutral third party, but for many, this isn’t an option. Consider this information as you decide whether you need a divorce lawyer.

A Divorce Lawyer can Fan the Flames

Choosing the wrong lawyer may be worse than not having one at all. Some lawyers are overly aggressive and can turn the divorce into a battle that goes on longer than necessary. Avoid creating additional tension by looking for a Calgary divorce lawyer who matches your level of intensity. If you want an amicable divorce, look for a lawyer that will work toward that; if you need a more aggressive lawyer, look for someone willing to go head to head with your spouse’s lawyer.

When to Hire a Calgary Lawyer

There are a number of situations when it makes a lot of sense to work with a divorce lawyer. If there is a problem with abuse, your spouse is being vindictive or dishonest, you have complicated finances, or your spouse has a lawyer, then you should contact a law firm and seek assistance. In these and other stressful situations, it’s challenging for people to represent themselves and negotiate effectively.

A Law Firm Helps You Through the Complicated Process

Divorce is a complicated legal process. Working with a law firm is a great way to make sure that everything is taken care of properly. Divorce lawyers are a great resource and can answer your questions and help the process proceed more smoothly.

Divorce is messy and complicated. Although you may be able to wade through the proceedings on your own, it’s usually wise to hire a Calgary lawyer.

Considering hiring a lawyer, but aren’t sure if it’s worth it? How do you know when it’s time to work with family lawyers? Here are some reasons to hire a family lawyer.

You Need a Family Lawyer if You or Your Spouse are Seeking a Divorce

Divorce proceedings are the most common reason people contact family lawyers. A family law firm handles matters related to divorce, such as settlement plans, child support, and dividing marital property. Both partners should hire a lawyer before beginning the divorce process.

You Need a Family Law Firm for Child Custody and Support

Calgary family lawyers also help clients deal with child custody and support issues. Custody and support are usually part of divorce cases initially, but if conditions change then, it may be necessary to revisit them with the help of a lawyer.

You Need Calgary Family Lawyers for Paternity Cases

The mother most often files paternity cases in an effort to make an absent father pay child support. However, sometimes fathers file paternity cases so they can have a relationship with their child. In either case, it’s important to have a family lawyer to assist you in the process.

You Need Family Lawyers if You Want to Adopt a Child

Adoption is complicated and varies based on many factors including where the child is from, the type of adoption, and the laws where you live. Consulting Calgary family lawyers is an important part of the adoption process because they understand the various regulations and can help you through the process.

If you’re facing any of the above situations, it’s time to hire a family law firm. Their legal expertise can help you through complicated processes related to divorce, child custody and support, paternity, adoption, and more.
